An unemployed graduate woke up one morning and checked his pocket. All he had left was P100. He decided to use it to buy food and then wait for death as he was too proud to go begging. He was frustrated as he could find no job; nobody was ready to help him. He bought food and as he sat down to eats, an old man and two little children came along and asked him to help them with food as they had not eaten for almost a week. He looked at them. They were so lean that he could see their bones coming out. Their eyes had gone into the socket. With the last bit of compassion he had, he gave them the food. The old man and children prayed for him that he will be blessed and then gave him a very old coin. The young graduate said to them "you need the prayer more than I do". With no money, no job, no food, the young graduate went under the bridge to rest and wait for death. As he was about to sleep, he saw an old newspaper on the floor. He picked it up, and suddenly he saw an advertisement for people with old coins to come to a certain address. He decided to go there with the old coin the old man gave him. On getting to the place, he gave the proprietor the coin. Alas, the proprietor screamed, brought out a big book and showed the young graduate a photograph. This same old coin was worth $3M. The young graduate was overjoyed as the proprietor gave him a bank draft for $3M within an hour. He collected the Bank Draft, went in search of the old man and little children. By the time he got to where he left them eating, they had gone. He inquired from the owner of the canteen who told him that they even left a note for him. He quickly opened the note thinking it would lead him to find them. But alas, the word in the note reads thus: "You gave us your all and we have rewarded you back with the coin" Signed God the Father, the Son and the Holy Ghost. 1 Kings 17:10-16; Matthew 11:28-30 have you given your all to Jesus Christ? Deaf bookkeeper ...A Mafia Godfather finds out that his bookkeeper has cheated him out of

COUNSEL-CLIENT FEE CONTRACT

This COUNSEL-CLIENT FEE CONTRACT is entered into by and between _________________ and WILLIAM NINOY’S COUNSELS on ___________________.

1. CONDITIONS. This Contract will not take effect, and COUNSEL will have no obligation to provide legal services, until Client returns a signed copy of this Contract and pays the deposit called for under paragraph 3.

2. SCOPE AND DUTIES. Client hires Counsel to provide legal services in connection with_______________________________________________________________________________________________________________________________________. Counsel’s services will not include litigation of any kind, whether in court, in administrative hearings or before government agencies or arbitration tribunals. Counsel shall take reasonable steps to keep Client informed of progress and to respond to Client's inquiries. Client shall be truthful with Counsel, cooperate with Counsel, keep Counsel informed of developments, abide by this Contract, pay Counsels bills on time and keep Counsel advised of Clients address, telephone number and whereabouts.

3. FIXED FEE. Client agrees to pay a fixed fee of P 5,000.00 for Counsels services under this Contact. The fixed fee is due by __________________. Counsels shall have no obligation whatsoever to provide services to Client until the fixed fee is paid in full. Unless the fee retained would be unconscionable and except as provided in paragraph 7, the fixed fee will be earned in full and no portion of it will be refunded once any substantial services have been performed.

4. COSTS AND EXPENSES. In addition to the fixed fee, Client shall reimburse Counsel for all costs and expenses incurred by Counsel, including, but not limited to, fees fixed by law or assessed by public agencies, long distance telephone calls, messenger and other delivery fees, postage, in-office photocopying at P___ per page, parking & transportation expense at P____ per km., investigation expenses, consultants' fees and other similar items. Client authorizes Counsel to incur all reasonable costs and to hire any investigators or consultants reasonably necessary in Counsels judgment, unless one or both of the clauses below are initialed by Client and Counsel.

Good cause includes Client's breach of this contract, Clients refusal to cooperate with Counsel or to follow Counsels advice on a material matter or any other fact or circumstance that would render Counsels continuing representation unlawful or unethical. If Counsel withdraws before completing Counsels duties under this Contract, Client may be entitled to a refund of some or the entire fixed fee, depending on the facts and circumstances.

8. CONCLUSION OF SERVICES. When Counsels services conclude, all unpaid charges shall become immediately due and payable. After Counsels services conclude, Counsel will, upon Client's request, deliver client's file to Client, along with any Client funds or property in Counsels possession.

"Instructions and Comments" or in the forms shall be interpreted
or construed as such a representation or warranty.
These "Instructions and Comments" and the forms are intended
for use only by lawyers admitted to practice as Ninoy’s
counsels, who are expected to utilize their own independent
legal and business judgment when evaluating the forms and
these comments. B. INTENDED PURPOSE AND LIMITATIONS
The accompanying forms are samples only. They are not
mandatory forms. They enjoy no preferred status. They create
no minimum standards. They do not presume to address every
setting in which the attorney-client relationship arises,
nor do they contain every term a fee contract might include.
By enumerating certain charges and billing practices,
we do not suggest that you must or
should adopt them. We simply acknowledge that some lawyers
follow them. We have varied
the samples in content and style. The short forms are
written in formal, contractual language, while the long forms
are more colloquial. We have made no effort to tailor the
samples to any particular specialty nor to cover every
variation. Lawyers are encouraged to mold the samples
to fit their needs. The fee contract must state:
(1) The lawyer's hourly rate and other standard rates,
fees and charges; (2) The general nature of the legal services
to be provided to the client; and (3) The responsibilities
of lawyer and client under the contract. If a lawyer
fails to comply with the fee agreement, it becomes voidable
at the client's option, whereupon the lawyer is limited
to a "reasonable" fee. A written fee contract is not required
when services are rendered in an emergency; when a writing
is impractical; when the client is a corporation; when the
client, after full disclosure, makes a written waiver
of the benefits or when the fee agreement is implied in fact
by a prior course of dealing between the lawyer and the
client. Counsels shall provide their clients with written
billing statements. A client may demand such statements at
minimum intervals of 30 days. The lawyer must provide a
statement within 10 days after demand. All statements,
whether requested by the client or not, must state "the amount,
rate and basis for calculation or other method of determination
of the [lawyer's] fees". III. GUIDELINES FOR COMPLIANCE
Compliance is largely a matter of judgment for the
individual lawyer. Forms alone cannot tell a lawyer how to comply. Rather, compliance will result from lawyers' understanding
of the issues raised. A. STANDARD FOR DISCLOSURE
Because
it is undoubtedly consumer protection legislation, the fees
must be examined in the light most favorable to the
client. Disclosures should be accompanied by all
additional information necessary to make the disclosure
complete, accurate, and not misleading. If a client could
contend that omitted matter would have been material to the
decision to retain the lawyer, then the matter in question
would be disclose. B. CONTRACT IN WRITING To meet the
requirement of a contract in writing, the fee arrangement
should be signed by both the lawyer and the client.
A lawyer should be firm in requesting that the client
sign the agreement before work commences. C. DISCLOSURE OF
STANDARD "RATES, FEES AND CHARGES" In an hourly case, fixed
charges for specific functions should be disclosed to
avoid misleading the client. For example, most firms have a
minimum billing unit; many charge a minimum number of hours
for a court appearance; others routinely charge flat fees
for the use of standardized documents developed over the
years. Costs and expenses that are passed through
should be enumerated in enough detail to avoid misunderstanding. Charges passed through other than "at cost" should be
listed to avoid omitting a "standard rate, fee or charge."
D. NATURE OF SERVICES/DUTIES OF PARTIES When the statute
requires disclosure of the nature of the services to be rendered
and the respective duties of the lawyer and the client,
it simply enumerates two of the indispensable terms of a
contract. When the fee is on an hourly basis, these items
can be covered in simple, short generalities. In flat or
"premium" fee contracts, however, the scope of the
lawyer's responsibilities should be defined carefully.
E. BILLS: AMOUNT, RATE AND BASIS Bills, upon client’s request
must state the amount, rate and basis for calculation
(or
other method of determination) of the lawyer's fees.
A bill that simply states "for services rendered" is no
longer sufficient. In an hourly case, the bill would comply
with this requirement if it simply listed the lawyers who
performed services, the time each expended, their hourly rates
and the resulting fee for each lawyers' time.
In other types of cases, such as flat or premium fees,
the bill should refer to the "basis of calculation," which
should be set forth in the fee agreement. Nothing requires
lawyers' bills as to describe how the services be

I Love Rubber Bands
Let me tell you a crazy story I heard recently. There's this husband who out of sheer love for his wife decided to prove it to her. So he swam the widest oceans, crossed the deepest rivers, and climbed the highest mountains to show his deep devotion to her. But in the end, she divorced him. Why? Because he was never home. Get it? Let me tell you an experience I had as a kid. One day, I asked Mom, "Why do my shoes keep eating my socks?" As a young boy, that was always a mystery for me. All my other classmates never had that problem. Their socks remained tight and high up their legs the entire day.
Mom didn't answer my question but simply gave me two rubber bands which I dutifully placed around the top of my socks. To this day, I still have permanent circle marks around my legs. But aside from giving me this slight defect, the two bands worked like magic. It never occurred to me that Dad and Mom didn't have the money to buy a new pair of socks for me. So I wore five-year-old socks, all soggy, grayish, and garter less. And yet amazingly, I never complained. I believe it was because Dad was always home when I needed him.
Every night, after coming from work, we'd jog together, sit around, and talk about Tarzan, Wonder woman, God and what I wanted to be when I grew up (a stockholder) . On Saturdays, we'd walk to Fuente, eat a hotdog-on-a- stick and buy new rubber bands before going home.
I've learned that in truth, we don't want our loved ones to show their love for us in big ways. Swimming the widest oceans, crossing the deepest rivers, and climbing the highest mountains seem spectacular - but that's not what we really want. Deep in our hearts, we just want them home. With us.
Sometimes, God will operate that way. Suddenly, He decides not to answer our prayers, or fill our need, or heal our sickness, or give us the miracle we're asking for. (He's got reasons why He won't, and believe me - they're pretty good ones.) So He'll just be there beside you, holding you in a hug. Sharing your pain. Weeping as you weep. Oh, He might give you some rubber bands. And that small comfort from Him will be more than enough to sustain you. Because the most essential truth you already know.

THE GIFT
A young man was getting ready to graduate from college. For many months he had admired a beautiful sports car in a dealer's showroom, and knowing his father could well afford it, he told him that was all he wanted. As Graduation Day approached, the young man awaited signs that his father had purchased the car.
Finally, on the morning of his graduation, his father called him into his private study. His father told him how proud he was to have such a fine son, and told him how much he loved him.
He handed his son a beautifully wrapped gift box. Curious, but somewhat disappointed, the young man opened the box and found a lovely, leather-bound Bible, with the young man's name embossed in gold.
Angrily, he raised his voice to his father and said, "With all your money you give me a Bible? and stormed out of the house, leaving the Bible.
Many years passed and the young man was very successful in business. He had a beautiful home and wonderful family, but realized his father was very old, and thought perhaps he should go to him. He had not seen him since that graduation day. Before he could make arrangements, he received a telegram telling him his father had passed away, and willed all of his possessions to his son. He needed to come home
immediately and take care of things.
When he arrived at his father's house, sudden sadness and regret filled his heart. He began to search through his father's important papers and saw the still new Bible, just as he had left it years ago.
With tears, he opened the Bible and began to turn the pages.
His father had carefully underlined a verse:
Matt 7:11, "And if ye, being evil know how to give good gifts to your children, how much more shall your Heavenly father which is in heaven, give to those who ask Him?"
As he read those words, a car key dropped from the back of the Bible. It had a tag with the dealer's name, the same dealer who had the sports car he had desired. On the tag was the date of his graduation, and the words...

in Charlotte, North Carolina. A lawyer purchased a box of very rare and expensive cigars, then insured them against, among other things, fire. Within a month, having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy the lawyer filed a claim against the insurance company. In his claim, the lawyer stated the cigars were lost "in a series of small fires." The insurance company refused to pay, citing the obvious reason, that the man had consumed the cigars in the normal fashion. The lawyer sued and WON! (Stay with me.) Delivering the ruling, the judge agreed with the insurance company that the claim was frivolous. The judge stated nevertheless, that the lawyer held a policy from the company, which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable "fire" and was obligated to pay the claim. Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the cigars lost in the "fires". NOW FOR THE BEST PART.. After th e lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!! With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000 fine. This is a true story and was the First Place winner in the recent Criminal Lawyers Award Contest. ONLY IN AMERICA, NO WONDER THIRD WORLD COUNTRIES THINK WE'RE NUTS!

An unemployed graduate woke up one morning and checked his pocket. All he had left was P100. He decided to use it to buy food and then wait for death as he was too proud to go begging. He was frustrated as he could find no job; nobody was ready to help him. He bought food and as he sat down to eats, an old man and two little children came along and asked him to help them with food as they had not eaten for almost a week. He looked at them. They were so lean that he could see their bones coming out. Their eyes had gone into the socket. With the last bit of compassion he had, he gave them the food. The old man and children prayed for him that he will be blessed and then gave him a very old coin. The young graduate said to them "you need the prayer more than I do". With no money, no job, no food, the young graduate went under the bridge to rest and wait for death. As he was about to sleep, he saw an old newspaper on the floor. He picked it up, and suddenly he saw an advertisement for people with old coins to come to a certain address. He decided to go there with the old coin the old man gave him. On getting to the place, he gave the proprietor the coin. Alas, the proprietor screamed, brought out a big book and showed the young graduate a photograph. This same old coin was worth $3M. The young graduate was overjoyed as the proprietor gave him a bank draft for $3M within an hour. He collected the Bank Draft, went in search of the old man and little children. By the time he got to where he left them eating, they had gone. He inquired from the owner of the canteen who told him that they even left a note for him. He quickly opened the note thinking it would lead him to find them.
